1. A Summary of the Contract
The photographer is responsible for providing for the client a photographic service and products
as detailed below.
2. The Coverage
Coverage will be provided by the photographer FMV in accordance with the package chosen.
The product shown during the consultation will be provided as agreed, if said product is no longer
available a replacement product will be provided. This replacement will be as close a match to
the original product as the photographer can source and provide.
It is mutually agreed that the following terms form an integral part of this contract and that no
variation or modification shall be effective unless accepted by Fay Vincent in writing.
BOOKING FEE
A wedding booking is considered firm on completion and signing of booking contract and receipt
of a BOOKING FEE of £250.00
This booking fee is not returnable except in the event of FMV cancelling the
booking.
FINAL BALANCE
The remaining balance for FMV wedding services (package price minus booking fee)
is required to be paid by 30 days prior to the wedding date.
Failure to make this payment by the due date may result in the cancellation of this wedding
agreement.
WEDDING CANCELLATION
The Client may cancel a wedding booking at any time by giving written notice to FMV but in
doing so shall forfeit any monies paid.
In the event of the Client cancelling a booking for wedding photography FMV reserves the right
to charge a cancellation fee 100% of the agreed fee if cancelled within 42 days of the wedding
date. This sum is payable as compensation as an estimate of the loss FMV would suffer.
Should the cancelled wedding turn out to be a postponement, then at the discretion of FMV and
subject to availability, monies may be applied to the new wedding.
ATTENDANCE
In the unlikely event that the photographer is unable to complete the coverage due to
unforeseen circumstances, the photographer reserves the right to appoint another photographer of equal skill and experience to attend on her behalf to undertake the photography. In the very unlikely event that no photographer can be provided FMV agrees to repay 100% of all monies paid by the client.
FULFILLMENT OF OBLIGATIONS
FMV shall not be liable to the Client for any failure, in whole or in part, to fulfil its obligations
where failure arises as a result of an event or circumstances beyond its control, which may
include (but are not limited to) equipment failure, inclement weather, illness or injury.
The Client understands and accepts that the photographic coverage will be as FMV professional
expertise determines. Special requests are not binding instructions although every effort is
made to comply with the Client’s wishes.
In the unlikely event of total photographic failure or cancellation of the contract by either party or
in any other circumstances, the liability of one party to the other shall be limited to the total value
of the contract (Package value). Neither party shall be liable for indirect or consequential losses.
WEATHER AND/OR DELAYS
Weather permitting the photographs will be taken as agreed. In the event of inclement weather
the photographer, in cooperation with the client, will make the necessary changes to the
schedule and will do their best to produce coverage of the wedding within the time allocated to
her.
COVERAGE
FMV cannot be held responsible for the lack of coverage caused the Bride,
The bridegroom or other members of the wedding party not being on time, nor by restrictions placed
on the photographer by the wedding venue. The Photographer(s) will document the events in a
candid manner and take formal portraits as requested. The client should provide a full list of
formal photographs required including names and relationship to the client at least 14 days prior to the wedding date.
The photographer will endeavour to honour requests for specific photographs subject the
following: weather and time permitting: availability and the cooperation of the person(s)
concerned. The photographer does not guarantee any specific picture nor include any
specific background, location, props or arrangement although every effort will be made to
interpret the client's wishes. The photographer is limited by the guidelines of the ceremony
official or reception site management. The client agrees to accept the technical results of any
imposition on the photographer.
COLOUR MATCHING and SIZES
Owing to photochromic anomalies caused by a combination of certain dyes and materials,
especially in man-made fibres, it is sometimes impossible to record on camera the exact colour
of materials as perceived by the human eye. When processing images, the photographer will
endeavour to achieve a pleasing overall colour balance based on natural flesh tones. It is
understood that some colours may not remain consistent throughout a set of photographs owing
to variations in lighting conditions. It is also understood that all photographic printing is
undertaken within the technical limitations of the process and that colour may not be identical
over the whole range within a subject.
FMV reserves the right to provide a black-and-white image as an alternative to a colour image if
correct colour balance cannot be obtained due to lighting conditions.
The colour balance of prints made at different times or in varying sizes may also be variable.
Due to the limitations of computer monitors, it is understood that images may appear differently
according to the specification of each monitor and that prints will not match images rendered on
any particular computer monitor.
The photographer accepts no responsibility for the quality and colour reproduced from third
party printers of images, due to variations in paper and third-party printing processes and
profiles.
COPYRIGHT
All final images will be provided on disk with a personal print release allowing you to print the
images for personal use. This print release is not a copyright release.
The copyright in all photographs created by FMV shall remain the property of Fay Vincent in accordance with the Copyright, Design and Patents Act 1988.
ELECTRONIC IMAGES
All electronic images created by FMV shall remain the property of Fay Vincent who
undertakes to store all such images safely and make them available for future reproduction for 6
months after the wedding date. Photographic prints will become and remain the property of the
Client(s). However, the Client(s) specifically acknowledge that ownership of prints does not imply
ownership of the copyright of the image.
MODEL RELEASE
The CLIENT hereby grants to FMV and its legal representatives and
assigns, the irrevocable and unrestricted right to use and publish photographs of the CLIENT or
in which the CLIENT may be included, for editorial, trade, advertising and any other purpose
and in any manner and medium; to alter the same without restriction; and to copyright the same.
The CLIENT hereby releases FMV and its legal representatives and
assigns from all claims and liability relating to said photographs.
ARTISTIC INPUT
Unless otherwise agreed between the Client and FMV, FMV shall be entitled to use their
judgement regarding the style and artistic input in the production of images. This includes but is
not limited to locations, poses and number of images taken. Due to the variances of weather
and the willingness of subjects it may not be possible to capture all the pictures requested, or
images to the client's full expectations. In the event of uncooperative children for example, at a session of any kind, for any reason, FMV may not be able to capture any, or all the images the Client may have requested or expected.
FINAL IMAGES
The term final images is used to describe the images the photographer has selected to have
edited and presented to the client. The photographer reserves the right to decide which images
are chosen.
There is no guarantee that any particular number of final images that will be produced.
The Client is to allow FMV up to 8 weeks for images to be edited. FMV will contact the client to
arrange a viewing of the final images once editing is completed. RAW /unedited files will NOT be provided to the client under any circumstances.
PRODUCTION OF FINE ART/COFFEE TABLE BOOK(S)
FMV will provide an example first draft of the Coffee Table/Fine Art Book(s) design to the client after the client selects the album images via the proofing page. The client may request changes to the original design as presented by FMV. Once the client has confirmed the layout/design/images used for The Fine Art Book(s) this cannot be amended.
FMV will review the products and if FMV feels they are of unsatisfactory quality will request
the product in question to be manufactured again.
FMV cannot be held responsible for any delay in delivering any products (disk/USB/Fine Art Book/coffee table book) due to any delay caused by suppliers used (this includes but is not limited
to, products needing to be manufactured again), or delivery methods used.
RETURNS POLICY (ALBUMS)
Incorrectly supplied items and items of poor quality can be returned and will be replaced at no
extra charge to the Client.
Returns will not be considered for incorrectly ordered items or items ordered in error.
The undersigned have read and understood the above contract and agree to the terms and
conditions in their entirety.
